Did You Know?

The actual costs to an agency for bringing in a foreign worker under the live in caregiver program are less than $200.00. It is also illegal for any agency to charge a skilled/unskilled foreign worker or Canadian citizen to find a job.

Terms

ACI does not have a mandatory charge for caregivers, nannies or employers. Our advice, phone assistance and 24 hour support is “always free”.  If you choose to employ Americanadian Inc. to represent you fully, making your process worry free for the next 2 year. Our fees are explained in this website under the caregiver/nanny division, or feel free to contact us anytime!

For employers

Whereas the Employer is in need of a nanny, caregiver or skilled worker;

Whereas ACI acts or will act as agent for nannies, caregivers and skilled workers who are prepared to move to Canada and be hired by Canadian employers to work in their chosen professions;

And Whereas it is in the best interest of both parties to work together in the recruitment and placement of qualified nannies/caregivers and skilled workers with the employer. Therefore it is hereby agreed that the individual parties will cooperate and perform the following services:

  • The Employer will provide ACI with information as to the Employer's staffing needs and job openings as they become aware of the same;
  • The Employer will also advise ACI when such positions have been filled by the Employer;
  • ACI will screen potential employees as to qualifications, language skills, eligibility to work in Canada and other requirements of the Employer;
  • ACI will make available the profiles of qualified potential employees to the Employer and facilitate the interviewing of the same by the Employer if required by the Employer;
  • ACI will keep all confidential information given to us, confidential as required by the Employer/Clients;
  • No other compensation shall be paid between the parties other than the mutual covenants herein;
  • ACI does not guarantee results and will not be responsible if the application is unsuccessful;
  • ACI is acting solely as a referral agent and at no time will be the Employee or Employer in the placement process. We do not assume any liability for the candidates; the total responsibility of selecting and employing a nanny rests entirely with the Employer;
  • ACI is not in any way liable for any loss, damage, expense or injury which the Employer or any other person may suffer or incur as a result of wrongful acts or negligence of the caregiver/skilled worker;

ACI assumes no responsibility for the payment or withholding of any taxes or deductions required by law, arising from the caregivers/skilled workers employment in the Employers home or elsewhere.  ACI is not responsible for any Government of Canada or Service Canada Fees for applications.

ACI will make available, all contacts and contractors for all named in this contract.  Should any of our joints attempts fail, with any government decisions, program paperwork and such, ACI will not be held responsible.  Every client and situation is unique.  Our expertise is in educating our clients in various options and professionally researching every possible situation and outcome.

This agreement may be terminated by either party, at any time with 30 days written notice of the parties intention to terminate this agreement. ACI. Will honor this contract for a maximum of "two years" from the date signed for caregivers/employers and “one year” for skilled/unskilled workers and corporate employers. ACI will not be held responsible if any information given by the clients is false or misleading.  Paperwork is based on the facts you give ACI. No refunds will be issued after payment is received.

SHOULD TERMINATION OF EMPLOYMENT OCCUR BY REASON OF MISDESCRIPTION OR MISREPRESENTATION CONCERNING THE DUTIES, WAGES OR TREATMENT OF THE APPLICANT OR IF YOU REFUSE TO SIGN A WORK AGREEMENT OUTLINING THE APPLICANT'S WORK HOURS, PAY AND DUTIES, THIS "REPLACE CAREGIVER/SKILLED WORKER AT NO EXTRA COST" CLAUSE IS VOID AND WILL BE CONSIDERED A BREECH OF CONTRACT BY THE EMPLOYER

Should the employer find a caregiver of their own choosing, ACI will assist you in completing a background check and personality test.  ACI will not be responsible for the caregiver unless they are also signed with ACI under contract.  If any issues or problems arise from the match, ACI will assume no responsibility towards the employer and the caregiver thus this contract becomes null and void.  ACI, however, first will offer you 90 minutes of counseling between you and your caregiver to ensure the issue(s) are not of a misunderstanding or inadequate information(s) being received.  If any further situations arise thereafter, ACI’s contract with you (the employer) will become void.

The Employer shall refrain from making any private agreement with the Applicant or from taking any action which is inconsistent with this agreement or which has the effect of avoiding any of the Employers obligations hereunder. Such private agreements and actions include, but are not limited to, actions which would enable the Employer or any other person to avoid payment of the placement fees due to ACI.

For Caregivers

Whereas the Employer is in need of a nanny or caregiver;

Whereas ACI acts or will act as agent for nannies and caregivers who are prepared to move to Canada and be hired by Canadian employers to work in their chosen professions;

And Whereas it is in the best interest of both parties to work together in the recruitment and placement of qualified nannies and caregivers with the employer. Therefore it is hereby agreed that the individual parties will cooperate and perform the following steps:

ACI will screen potential employees as to qualifications and language skills through testing and review of resume of the Applicant;

ACI will make available the profiles of qualified applicants to the Employer and facilitate the interviewing of the same by the Employer if necessary;

ACI will assist the Employee in filing the applications for a Work Permit to work in Canada and will continue to assist you in your work ethics while here.

The Applicant acknowledges that ultimately the obtaining of employment will depend on the joint efforts of the parties and that by signing this agreement, there is no guarantee by ACI to the Applicant of obtaining employment for the Applicant;

ACI has the right to terminate this agreement without refund to the Applicant of any fees paid if it is determined that the information provided by the Applicant is false or misleading.

ACI will act responsible for the Applicant for up to 2 years of the signed date on this contract. If the applicant goes against ACI in damaging the reputation of the Employer or ACI, this contract will be void and no refund issued.  ACI will always do what is best for the applicant, if you should so choose to change circumstances without informing ACI, we will not be responsible for you.

In the event that employment is obtained, then the Applicant agrees to enter into an agreement for up to two years. At no time will any refunds be issued after payment is made to ACI.

ACI. shall not be held responsible for any official/government documents being received.  Processing times and delays with work permits, labor market opinions or any other important papers, are in the hands of the Government of Canada.  Delays must be expected as ACI must follow the rules and regulations prior and during the submission of all applications.

ACI will not be held responsible for you in any way if you are released by your employer for reasons surrounding any misunderstandings, your work or work ethics with them or with whom you are caring for.  ACI will not be held liable or responsible for you as of your date of release.  If you are released due to unemployment reasons or having a caregiver is an unaffordable situation for the family, these reasons are not of your doing and we will act responsible for you for the duration of our contract.

ACI will ensure the safety and well being of the applicant at all times, and you as the employee will inform ACI of any issues or concerns. - No physical or verbal abuse is ever permitted and not tolerated.
